TERMS OF SALE ORDERS SHIPPED OUTSIDE THE UNITED STATES

General Sales Policy

Online sales are restricted to business-to business transactions only. Acceptance of all orders is subject to credit approval by Dynacon. No order shall be deemed accepted until it is verified by Dynacon and an order acknowledgement has been returned to the Purchaser. Minimum billing per order is $25.00 plus freight charges.

Payment Terms

Order acceptance is based on payment in U.S. funds prior to shipment by Visa, MasterCard, or Discover.

General Pricing Policy

Prices are based on quantity-per-order of each part number purchased for shipment at one time. Different part numbers cannot be combined for quantity pricing. Quotations on larger quantities of any product are available upon request. At its discretion, Dynacon may offer special prices for products purchased online which are different than prices published in its current hard copy price list. Freight and handling fees will be added to each shipment. Prices are subject to change without notice. In the event of a price change, the unshipped portion of any order may be billed at the new price.

All Shipments are F.O.B. Point of Origin

UPS Worldwide or UPS International freight charges plus a $2.00 handling fee will be automatically calculated and displayed in the Shopping Cart. Purchaser is responsible for obtaining insurance. Title and risk of loss or damage pass to the Purchaser upon delivery to the common carrier in the United States. Claims for loss or damage in transit must be filed with the freight carrier, vessel and/or insurance company by the Purchaser. Unless otherwise instructed, partial shipments will be deemed to be acceptable.

Shipping Options

The Purchaser can use the online shipping options to select shipment via UPS Worldwide Express, Worldwide Expedited, or International Standard where available. Upon request, other options include Federal Express International or freight forwarders as chosen by the Purchaser. For freight collect shipments, use the "Special Instructions" block on the Shopping Cart to provide the name and address of the freight forwarder and the consignee's account number. When freight collect shipments are invoiced, the freight charges shown in the Shopping Cart will be deducted. Large actuators and valves which exceed UPS weight limits, or are crated for shipment, must be shipped freight collect.

Export & Import Documentation, Duties, Taxes, and Fees

Purchaser is responsible for obtaining and paying for any permits, licenses, or other government authorizations necessary for the exportation or the importation of the products into the country of importation. All duties and taxes are the responsibility of the consignee. Purchaser shall select and pay the freight forwarder who shall be solely the Purchaser's agent.

Leadtimes

Most parts are shipped from inventory in two working days or less from receipt of order. Products dropshipping directly from manufacturers or out of stock may require two to four weeks to ship. The availability of any part can be determined by utilizing the online contact us feature.

Sales Tax

Dynacon does not collect sales taxes on material purchased outside the State of Virginia. When applicable for other locations, it is the Purchaser's responsibility to maintain tax exemption records and report and pay sales taxes as required.

Credit Balances

Purchaser agrees that any credit balance issued will be applied within one year of its issuance. If not applied or requested within one year, any remaining balance will be subject to cancellation, and Dynacon shall have no further obligation.

Warranty Policy & Disclaimers

Specifications provided by the product manufacturers are deemed to be correct, but Dynacon does not guarantee their accuracy or completeness. All product dimensions are nominal, and Dynacon should be contacted if more precise dimensions are required. Product cross reference information is based on functional equivalency and does not imply that performance and other characteristics are perfectly comparable. Dynacon functions solely as a distributor of products manufactured by other companies, and Dynacon's liabilities are expressly limited to those warranties and guarantees that are extended by the product manufacturers. Dynacon makes no other warranty claims, and there are no implied warranties of merchantability or fitness. In no event is Dynacon responsible for consequential damages. The Purchaser is responsible for installation and use of the products in accordance with the manufacturer's instructions.

Returned Material Policy

Prior authorization from Dynacon must be obtained for material being returned for any reason. The Return Authorization Form supplied by Dynacon must be completed and packaged with the return. Returns are to be shipped freight prepaid to the address designated by Dynacon. If the product is defective and in warranty, Dynacon will prepay normal UPS charges for replacement. Orders for advance replacement parts will be invoiced at prevailing product and freight costs. If the returned parts are found to be defective and in warranty, an offsetting credit in the amount of the product costs and least expensive freight charges will be issued by Dynacon. Non-defective material returned for credit must be received freight prepaid in new and resalable condition. Upon satisfactory inspection, Dynacon will issue a credit less a 15% restocking charge for the material only (a 25% restocking applies for 2" and larger valves built to order). All returned material that does not have a properly assigned Return Authorization Number or does not comply with this policy will be returned to the sender.

Right of Substitution

Dynacon reserves the right to substitute products of equivalent specifications provided the product's operational characteristics are not effected.
